This website is operated by Richard & Helen. Throughout the site, the terms "we", "us", "our" and "entrepreneur" refer to Richard & Helen. Richard & Helen offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site and/or purchasing anything from us, you agree to our "Service" and agree to be bound by the following terms and conditions of service ("Terms of Service", "Terms"), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, suppliers, customers, vendors and/or content contributors.

Please read these Terms of Service carefully before visiting or using our site. By visiting or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms of this agreement, you will not be able to access the site or use any services.

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

ARTICLE 1 - DEFINITIONS

In these terms and conditions, the following definitions shall apply:

  • Reflection period: the period within which the consumer can exercise his right of withdrawal (30 days);
  • Consumer: the natural person who is not acting in the exercise of a profession or business and enters into a distance contract with the entrepreneur;
  • Right of withdrawal: the possibility for the consumer to waive the distance contract within the cooling-off period;
  • Entrepreneur: Richard & Helen;
  • Distance contract: an agreement whereby, within the framework of a system organized by the entrepreneur for distance selling of products and/or services, exclusive use is made of one or more techniques for distance communication.

ARTICLE 3 - APPLICABILITY

These general terms and conditions apply to every offer of the entrepreneur and to every distance contract and order concluded between entrepreneur and consumer.

ARTICLE 4 - THE OFFER

The offer contains a complete and accurate description of the products and/or services offered. If the entrepreneur uses images these are a true representation of the products and / or services offered. Obvious mistakes or obvious errors in the offer do not bind the entrepreneur.

All prices are subject to customs clearance charges and import VAT where applicable. These additional costs will be at the customer's expense and risk.

ARTICLE 5 - THE AGREEMENT

The agreement is concluded at the moment of acceptance by the consumer of the offer and the fulfillment of the corresponding conditions. The entrepreneur will immediately confirm receipt of acceptance of the offer electronically.

ARTICLE 6 - RIGHT OF WITHDRAWAL

When purchasing products, the consumer has the option of dissolving the agreement without giving reasons for 30 days. This reflection period starts on the day after receipt of the product by the consumer or a representative previously designated by the consumer.

During the reflection period, the consumer will handle the product and packaging with care. If he exercises his right of withdrawal, he will return the product with all accessories supplied and - if reasonably possible - in the original condition and packaging to the entrepreneur.

To use his right of withdrawal, the consumer is obliged to make this known to the entrepreneur within 30 days via email to support@richardandhelen.com. After notification, the customer must return the product within 14 days.

ARTICLE 6A – ORDER CANCELLATIONS

Once an order has been processed or dispatched, cancellation is no longer possible. If your order has already entered the shipping or fulfilment stage, the order must be received first, and you may then return it following the steps outlined in our Return Policy.

ARTICLE 7 - COSTS IN CASE OF WITHDRAWAL

If the consumer exercises his right of withdrawal, the cost of returning the products will be borne by the consumer.

ARTICLE 8 - EXCLUSION OF RIGHT OF WITHDRAWAL

The entrepreneur can exclude the consumer's right of withdrawal for products that have been created in accordance with consumer specifications, are clearly personal in nature, or cannot be returned due to hygiene reasons if the seal is broken.

ARTICLE 9 - THE PRICE

Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue the Service without notice at any time.

ARTICLE 10 - CONFORMITY AND WARRANTY

The trader guarantees that the products comply with the contract and reasonable requirements of soundness and usability. Any defects or incorrectly delivered products should be reported to the entrepreneur in writing within 30 days of delivery. Return of the products must be in the original packaging and in new condition.
